*The listed charge or documented current replacement cost applies, whichever is greater. Replacement cost may include necessary delivery, import duties and taxes required to obtain an equivalent replacement in Kenya. These costs will be explained in the assessment and will not be counted twice.

Any equipment not listed here will be assessed according to its documented repair or replacement cost. Ocean Tribe will explain the basis of the proposed charge.

A complete-set charge will not be added to individual replacement charges for the same items. Where only part of a set is affected, the assessment will identify the relevant item or component.

How the policy works

How charges are calculated

We assess the circumstances, the affected equipment and the work needed to repair or replace it. You will receive an explanation of any proposed charge.

Repairable damage

Where equipment can be safely and reasonably repaired, the charge reflects the necessary parts, labour and associated repair costs. The full replacement charge is not automatically applied to minor damage.

Lost or irreparable equipment

Where equipment is lost, not returned or cannot reasonably be repaired, the charge is the listed amount or documented current replacement cost, whichever is greater. Repair and full replacement costs are not both charged for the same item.

Loss of rental revenue

Where the loss or damage directly causes a demonstrable loss of rental revenue, Ocean Tribe may seek recovery of that loss where permitted by law. This is assessed separately and is not a fixed daily penalty.

Any claim will identify the affected period, calculation and supporting evidence, taking account of available replacement equipment, avoided costs and reasonable steps to reduce the loss.

Clear assessment and explanation

We will identify the affected item and explain the proposed charge. Supporting photographs, repair assessments or supplier quotations will be provided where available. Guests may ask questions or dispute the assessment before the charge is finalised.

Looking after shared equipment

Your equipment responsibilities

Take reasonable care of equipment issued to you, keep it secure and follow the team’s instructions. Do not leave equipment unattended or unsecured contrary to those instructions.

Report any loss, damage or malfunction immediately. Return all equipment directly to an Ocean Tribe team member after your activity or at the agreed return time.

Charges apply where loss or damage results from negligence, misuse, deliberate actions or failure to follow reasonable instructions. Guests are not charged for normal wear and tear, pre-existing damage, equipment defects or loss or damage caused by Ocean Tribe staff.

Equipment questions

Before your activity

Are these equipment purchase or rental prices?
No. This is a loss and damage charge schedule. It does not advertise equipment for sale or show daily equipment rental rates.
Will every damaged item be charged at full replacement value?
No. Repairable damage is assessed according to the work needed to restore the item to safe, serviceable condition. Replacement charges apply to lost, unreturned or irreparably damaged equipment where the guest is responsible.
Can the final charge exceed the listed price?
Yes. If the documented current replacement cost is greater than the listed amount, the replacement cost applies. Any applicable claim for lost rental revenue is explained separately rather than included as an automatic surcharge.
What if I notice damage before using the equipment?
Tell an Ocean Tribe team member before using it. Ask for the item to be checked and, where needed, replaced. Pre-existing damage and equipment defects are not charged to the guest.
What if an item is not on the list?
Ocean Tribe will assess the documented repair or replacement cost and explain the proposed charge. If you have questions about a particular item, ask the team before accepting it.
